Video footage of a verbal altercation between Lee Pomeroy who suffered 18 knife wounds in an assault which led to his death and Darren Pencille has been released. Mr Pencille denies murder on the grounds of self-defence and the trial is continuing with the Jury having been shown the trains CCTV film of the final frenzied few seconds of Lee Pomeroy’s life. The defendant is pleading not guilty on these grounds despite seeming to be giving as much as he was getting in the verbals. To succeed in getting the charges removed or reduced he would need to prove that the force used was reasonable and proportionate to the situation. Despite the tragic circumstances it will be interesting to see how this one pans from a legal standpoint.
