{"id":2235,"date":"2020-05-28T14:54:56","date_gmt":"2020-05-28T14:54:56","guid":{"rendered":"http:\/\/www.fiveminutesspare.com\/legal\/?p=2235"},"modified":"2022-04-29T11:30:32","modified_gmt":"2022-04-29T11:30:32","slug":"joint-tenancy-tenants-in-common","status":"publish","type":"post","link":"https:\/\/www.fiveminutesspare.com\/legal\/joint-tenancy-tenants-in-common\/legal-services\/individuals\/property","title":{"rendered":"Joint Tenancy, Tenants in Common"},"content":{"rendered":"<p><span data-preserver-spaces=\"true\">When multiple people own property or Land, this is known as being co-owners.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">There are two different types of Co-owners:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Joint Tenants and;<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Tenants in Common<\/span><\/li>\n<\/ul>\n<h2><span data-preserver-spaces=\"true\">Joint Tenancy<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">In a Joint Tenancy, each person has a unified share in the property. Therefore, under a Joint Tenancy, each and all the co-owners are equally entitled to the whole property. The result of this means that if one of the co-owners dies the surviving co-owner or owners will then share the full property, this is known as the right to survivorship.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Tenants in common<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">When Co-owners hold property as Tenants in Common, this means that unlike Joint Tenants, they have a defined and distinct share of the property.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Severing a Joint Tenancy\u00a0<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Co-owners who are Joint Tenants can Sever the Tenancy in multiple ways; however, for this article, we will discuss severing Tenancy by Mutual Agreement or Mutual Conduct.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Mutual Agreement<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Joint Tenants can agree to sever their Joint Tenancy. The agreement we advise is being in writing, and correctly worded to avoid any ambiguity.\u00a0\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Mutual Conduct<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Another way to sever a Joint Tenancy is through a &#8220;course of dealing&#8221;. A typical &#8220;course of dealing&#8221; is a Mutual\/Joint Will. A Mutual Will gives the Co-owners opportunity to create a binding contract severing the Tenancy and therefore can distribute their share of the property withing having to follow
